GST withholding on land: a quick explainer
The Hidden Valley contract includes a GST withholding section. Here's what it's about.
The REIWA contract has a section on GST withholding, and the Hidden Valley contract includes a GST withholding annexure.
What it is
For some purchases of new residential premises or potential residential land, the buyer is required to withhold part of the price and pay it directly to the Australian Taxation Office at settlement.
How the contract handles it
The contract schedule asks whether the sale is a taxable supply that requires withholding. If it does, the annexure sets out how it’s handled.
Who manages it
Your settlement agent manages any withholding as part of settlement.
Ask your settlement agent They’ll explain how it applies to your contract.
