How to buy land in WA from interstate, step by step

From choosing a lot to settlement: how the contract, deposit and settlement work when you buy WA land from another state.

Buying land in another state can feel complicated, but in practice it’s straightforward. Here’s how buying a lot at Hidden Valley works, step by step, if you live in NSW, Victoria, Queensland or anywhere else in Australia.

Step 1: Do your homework online

Start with the information that’s available without leaving home:

Terry can also email you the contour survey plan, aerial photos and a sample sales contract, so you know exactly what you’d be signing.

Step 2: Choose a lot and talk to Terry

Once you’ve narrowed it down, call or email Terry McBratney (0408 554 444). He can tell you about specific lots, answer questions about the contract and arrange a site visit if you’d like one.

If the lot you want is under offer, you can ask to be registered as a back-up buyer.

Step 3: Send your details

To prepare the contract, Terry needs:

  1. The full name of each buyer, including any middle names
  2. The address of each buyer
  3. The lot number you want to buy
  4. If you’re financing, your lender’s name and the amount you’ll borrow

Step 4: Sign the contract

WA land sales use the REIWA “offer and acceptance” contract, together with the standard 2022 General Conditions. You make an offer by signing it, and it becomes binding once the seller accepts.

The Hidden Valley contract includes a few special conditions that are normal for this kind of land, including a bushfire prone area annexure and a sunset clause annexure. If you’re borrowing, a finance clause can be included so the contract depends on your loan being approved.

Get independent advice Before signing any contract, it’s sensible to have your own settlement agent or solicitor look over it. In WA, settlements are commonly handled by licensed settlement agents.

Step 5: Pay the deposit

The deposit is $10,000, paid within 7 days of acceptance. It’s held in the settlement agent’s trust account until settlement.

Step 6: Wait for titles and settle

Settlement happens 14 days after the titles are available, which is expected in mid-2027. There’s nothing more to pay until then. At settlement you pay the balance of the purchase price, and WA transfer (stamp) duty is payable to RevenueWA. Your settlement agent will give you the exact figures.

A note for buyers who aren’t Australian citizens

If you’re not an Australian citizen or permanent resident, you may need approval from the Foreign Investment Review Board (FIRB) before buying, and other conditions can apply. Get advice before making an offer.

After settlement

There’s no time limit to build and no covenants, so the timing is up to you. When you’re ready, choose a builder, design your home and apply for Shire of Irwin approval. The Builders page is a good place to start.
